What if I made a mistake in my eFiling?

Go to federal/district court policy link

If you did not submit your eFiling yet, then you really didn't make mistake, since the eFiling has not submitted to the court. Simply click on any menu item to start over.

If you have submitted the document it cannot be removed from the court files without the order of the judge, however this is not usually needed.

The first thing to do is determine the severity of the issue.

Remove an Efiled Document

If a PDF document was efiled that contained:

  1. Information that must not be viewed by the public as a whole, such as a document meant to be filed under-seal;
  2. Confidential material in violation of privacy rules set forth by the court;
  3. Irrelevant private information, such as passwords, etc.;

...then the document must be removed ASAP.

Immediately notify the court of the case number, docket number and a very brief description of what went wrong, then follow up with a phone call to expedite our response. Most courts can place a temporary "lock" on the document to prevent future access. You must file a Motion to Remove Incorrectly Filed Document, ASAP. Once this motion is granted, the document can be permanently removed from ECF.

If there is a corrected version of the document efiled in error, you do not need to wait, you can immediately re-efile it.

Re-Efiling

Simply going back and re-efiling the entire corrected entry will provide the court with the correct document and also make sure the corrected version is served on everyone. You must then notify the ECF Helpdesk of the change via email. If there is no new entry (such as if you efiled in the wrong case), just notify the ECF Helpdesk via email with the case number and docket number, and a very brief description of what went wrong.

Note: If your only error is that you left something out of the filing, like the Proposed Order or an Exhibit, then DO NOT efile the whole thing again as shown below. Simply just efile whatever you left out under it's own category, and refer it back to the previously filed document(s).
